Weinstein’s Newest Feature: How to Shut-Up Thy Adversaries

Harvey Weinstein Hires ex-Mossad Agents For “Damage Control”

Harvey Weinstein, a bully to the end, apparently sought to shut-up his accusers and the journalists poised to break the stories of his sordid sexual exploits.

The New Yorker, in the forefront of breaking stories on Wienstein. revealed yesterday that Harvey hired an Israeli private investigation firm whose successes tout creative results in difficult circumstances.

In a detailed article, Weinstein’s Army of Spies by Ronan Farrow, Weinstein apparently used the investigative firm Black Cube based in Tel Aviv, to dig-up dirt on his opponents. Presumably the only reason to do so is to intimidate those who could cause him damage, into remaining forever silent – or else.

Black Cube’s website touts itself as a “select group of veterans from the Israeli elite intelligence units [specializing] in tailored solutions to complex business and litigation challenges.”

According to Farrow, “over the course of a year, Weinstein had the agencies “target,” or collect information on, dozens of individuals, and compile psychological profiles that sometimes focused on their personal or sexual histories. Weinstein monitored the progress of the investigations personally.”

Who Hired Black Cube for Weinstein?

But who really hired Black Cube? Farrow reveals some of the work was contracted to lawyers including well-known David Boies, Esq.

Boies, best known for his work representing Al Gore in the 2000 presidential election dispute, “personally signed the contract directing Black Cube to attempt to uncover information that would stop the publication of a Times story about Weinstein’s abuses ….” according to Farrow. Boies also mans-up when acknowledging, “We should not have been contracting with and paying investigators that we did not select and direct ….” he tells Farrow.

What are the Legal Consequences?

While New York’s Attorney General investigates rape charges against Weinstein, ramifications from these latest developments remains unclear.

Whether prosecutors could obtain the content of discussions or of documents generated by Black Cube to use against Weinstein appears challenging where the operation was run through lawyers, thus invoking prohibitions to disclosure by the attorney-client and attorney “work product” doctrines. And where Black Cube remains afar from U.S. issued subpoenas if its Weinstein operations emanated from Tel Aviv, this, too, adds hurdles to ferreting out the information.

But one matter remains clear. The attempts by Weinstein to bully individuals to “dumb down” or shut-up, is further evidence of his guilt even if the content of his “black ops” investigations are never revealed.

TWC Update October 20, 2017 – Since having written Abusive Power last week, Harvey Weinstein’s troubles have increased exponentially. Or, as screen buffs might say, at Warp Speed. And women continue to come forward, brave-up and tell their Weinstein stories.

One woman, Oscar winning actress Luptia Nyong’o, exposes Harvey’s method. And screen director Quentin Tarantino says he should have stepped-up to stop it a long time past.

Luptia Nyong’o Exposes Weinstein’s Methods

October 19, 2017 – Lupita Nyong’o, Best Supporting Actress at the 2014 Oscars, for her performance in the best film of the year, 12 Years A Slave (Brad Pitt produced) braves-up to detail Harvey Weinstein’s methods. She authors her compelling account in today’s New York Times.

From Luptia’s powerful account:

Harvey arrived and the assistant immediately disappeared. We ordered drinks and starters. Again he was offended by my nonalcoholic beverage choice but he didn’t fight me on it as hard. Before the starters arrived, he announced: “Let’s cut to the chase. I have a private room upstairs where we can have the rest of our meal.” I was stunned. I told him I preferred to eat in the restaurant. He told me not to be so naïve. If I wanted to be an actress, then I had to be willing to do this sort of thing. He said he had dated Famous Actress X and Y and look where that had gotten them.

I was silent for a while before I mustered up the courage to politely decline his offer. “You have no idea what you are passing up,” he said. “With all due respect, I would not be able to sleep at night if I did what you are asking, so I must pass,” I replied.

His whole demeanor changed at that point. “Then I guess we are two ships passing in the night.” I had never heard that saying before, so I remember asking him what it meant. “It means just that,” he said. “We are two ships going in two different directions.”

“Yes, I guess we are.”

“So we are done here,” he said. “You can leave.”

Film Director Quentin Tarantino Remorseful in Not Having Taken Stronger Stand

October 19, 2017 – Acclaimed film director, Quentin Tarantino, is genuinely remorseful in not having taken a stronger stand, much earlier when he became aware of Harvey Weinstein’s conduct toward actresses.

“I knew enough to do more than I did.” he said, citing several episodes involving prominent actresses. “There was more to it than just the normal rumors, the normal gossip. It wasn’t secondhand. I knew he did a couple of these things.”

“I wish I had taken responsibility for what I heard,” he added.

Motion Picture Academy Expels Weinstein

October 14 2017 – The Academy of Motion Picture Arts and Sciences (“Academy”) expelled Harvey Weinstein. The Academy’s Board of Governors, in Emergency Session, cast votes substantially exceeding the necessary two-thirds majority of voting for Weinstein’s ousting.

“We do so not simply to separate ourselves from someone who does not merit the respect of his colleagues, but also to send a message that the era of willful ignorance and shameful complicity in sexually predatory behavior and workplace harassment in our industry is over. What’s at issue here is a deeply troubling problem that has no place in our society.” From the Academy’s official statement.

British Film Institute Revokes Highest Honor

October 19, 2017 – The British Film Institute revokes its highest award given Weinstein.

“The serious and widespread allegations about Harvey Weinstein’s appalling conduct are in direct opposition to the BFI’s values.” BFI’s official statement.
